1. Organizer Information

This fundraiser is organized by ibCheechy (“Organizer”) to raise funds for medical and related expenses for the Organizer’s father, Todd D. (“Beneficiary”).The Organizer is acting in an individual capacity and is not a registered nonprofit organization unless otherwise stated.

2. Purpose of Funds

Funds raised through this fundraiser will be used to support:- Travel to and from medical appointments and treatment centers
- Accommodation related to treatment travel
- Lost income due to illness
- Daily living expenses impacted by the Beneficiary’s condition
- Accessibility needs, supportive care, or comfort-related expenses
- Any other illness-related financial burdens as determined necessary by the BeneficiaryIn the event of the Beneficiary’s passing, remaining funds may be used to support the Beneficiary’s spouse with:- Funeral or memorial expenses
- Outstanding illness-related costs
- Living expenses and financial stability during the adjustment periodAll funds raised are intended for the direct benefit of the Beneficiary and, where applicable, the Beneficiary’s spouse. The Organizer’s role is limited to administering and transferring funds for these stated purposes.

3. Nature of Donations

All contributions are voluntary donations.- Donations are not investments.
- Donations do not create any ownership, partnership, agency, or contractual relationship with the Organizer or Beneficiary.
- Donations are generally non-refundable, except where required by platform policy or law.

4. Donation Incentives & Milestone Rewards

The fundraiser may include:- Donation-based incentives
- Milestone unlocks
- Digital rewards
- Physical rewards
- Live-stream participation rewards
- Auction itemsImportant conditions:- Incentives are offered as thank-you gifts, not purchases.
- Delivery timelines may vary.
- The Organizer reserves the right to substitute items of equal value if necessary.
- Milestone rewards are only unlocked if the stated fundraising goal is met.
- Some rewards may require donor-provided contact information.If a donor fails to provide required information within 7 days, the reward may be forfeited.

5. Auction

5.1 Nature of Auction Items- Auction items are offered as part of a charitable fundraising effort connected to the Dad-A-Thon event. Winning bids constitute a binding commitment to complete payment for the amount bid.
- All items are provided “as is” unless otherwise specified.5.2 Goal-Dependent Items- Some items are listed as “Goal-Dependent Items.” These items may be bid on in advance; however, they will only be awarded if the specified Twitch Goal Point threshold is reached before the close of online bidding. The required goal amount is noted in each individual item description.
- If the applicable goal is not met, the item will not be awarded and no sale will be completed for that item. By placing a bid on a Goal-Dependent Item, bidders acknowledge and agree to these conditions.For the purposes of this auction:
- 1 Twitch Goal Point is awarded for each Tier 1 or Prime Twitch Subscription
- 1 Twitch Goal Point is awarded for every 500 Bits donated
- 2 Twitch Goal Points are awarded for each Tier 2 Twitch Subscription
- 5 Twitch Goal Points are awarded for each Tier 3 Twitch Subscription
- 1 Twitch Goal Point is awarded for each Gifted Subscription
- 1 Twitch Goal Point is awarded for each $5 donated through Ko-fi or GoFundMe- Goal Point totals are tracked publicly during the event.
- After an auction item purchase is successfully completed, the value of that purchase will also be converted into Goal Points and added to the total.5.3 Bidding & Payment- Winning bidders must make contact within seven (7) days of auction close to receive payment instructions and begin fulfillment.
- Payment must be completed in full within seven (7) days of receiving payment instructions. No fulfillment will begin until payment has been received in full.
- If no contact is made within seven (7) days, or payment is not completed within the specified timeframe, the item may be forfeited at the Organizer’s discretion.5.4 Non-Payment & Community AccessFailure to complete payment for a winning bid may result in permanent removal from the ibCheechy community, including but not limited to Discord/Root servers, Twitch channels, and future events or auctions.The Organizer reserves the right to disqualify fraudulent, bad-faith, or disruptive bidders.5.5 No RefundsAll auction payments are final and non-refundable except where required by law or platform policy.Fraudulent chargebacks or bad-faith payment disputes may result in:
- Revocation of the associated item or reward
- Permanent removal from the ibCheechy community
- Disqualification from future participation5.6 FulfillmentDigital items will be delivered electronically via an agreed-upon method.Physical items, if applicable, will be shipped to the address provided by the winning bidder. Shipping timelines are estimates, and the Organizer is not responsible for postal delays, customs fees, or carrier-related issues once shipped.

6. Shipment & Fulfillment (non-auction items)

For physical items:- Shipping timelines are estimates.
- Organizer is not responsible for delays caused by postal services.
- International shipping may incur customs fees, which are the responsibility of the recipient.
- Lost or damaged shipments may not be replaceable.

7. Digital Rewards

Digital rewards may include:- Downloadable files
- Access to private content
- Credits/shoutouts
- Custom digital creations
- Private Communications/SessionsDigital rewards are for personal use only and may not be resold, redistributed, or commercially exploited.
Contact for digital sessions must be made within 7 days and scheduling must be arranged within 30 days unless otherwise agreed. Failure to schedule may result in forfeiture.

7. Platform Policies

This fundraiser operates in accordance with the policies and terms of service of any third-party platforms used in connection with the Dad-A-Thon event, including but not limited to Twitch, Ko-fi, Fourthwall, GoFundMe, AirAuctioneer, Discord, Root and related payment processors.All participants agree to comply with the applicable terms of those platforms.

8. Changes & Modifications

The Organizer reserves the right to update or modify these Terms & Conditions, reward structures, milestone thresholds, auction details, or event mechanics as necessary.Any updates will be posted publicly where the fundraiser is hosted and will take effect upon posting.

9. Limitation of Liability

To the maximum extent permitted by law, the Organizer shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in this fundraiser, including but not limited to auctions, donation incentives, digital rewards, or shipment of physical items.Participation in this fundraiser is voluntary and at the participant’s own discretion.

10. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance within the laws of the province of Ontario, Canada, without regard to conflict of law principles.
